Terms of Service

Important: InstantFocus outputs are AI-generated synthetic content intended as directional signals only — not validated consumer research.

These Terms of Service govern your access to and use of the InstantFocus API, website, and related services. By creating an account or using the Service, you agree to be bound by these Terms.

Service description

InstantFocus provides an AI-powered synthetic panel evaluation API. You submit stimuli via a REST endpoint and receive structured synthetic consumer feedback. The Service uses OpenAI gpt-4o-mini. All outputs are entirely AI-generated and do not represent real individuals.

AI output disclaimer

THE API OUTPUTS ARE AI-GENERATED SYNTHETIC CONTENT PROVIDED FOR DIRECTIONAL RESEARCH PURPOSES ONLY. INSTANTFOCUS MAKES NO REPRESENTATION THAT OUTPUTS ARE ACCURATE, STATISTICALLY VALID, OR SUITABLE FOR COMMERCIAL DECISION-MAKING.

Account terms

You must be at least 18 years old. You are responsible for securing your API key and all activity under it. Notify us immediately if your key is compromised.

Acceptable use

  • Do not present API outputs as real consumer research without disclosure
  • Do not use outputs for automated high-stakes decisions without human review
  • Do not reverse-engineer the service or use outputs to train competing models
  • Do not resell raw API access as a standalone product

Intellectual property

You own your inputs and outputs. InstantFocus owns the Service. Consistent with OpenAI's terms, we do not claim ownership of outputs generated for your requests.

Payment terms

Credit-based pricing. Credits are non-refundable once consumed. Unused credits eligible for refund within 30 days if less than 10% used. 30 days notice for price changes.

Limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY. TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE PRECEDING 12 MONTHS. IN NO EVENT SHALL INSTANTFOCUS BE LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Termination

You may terminate at any time. We may suspend or terminate for Terms violations. Sections on IP, liability, and dispute resolution survive termination.

Governing law

Governed by the laws of the State of Delaware, United States. Disputes resolved by binding arbitration (AAA Commercial Rules). Class action waiver applies.
